Part I — Terms of Service

1. Acceptance of Terms

These Terms of Service, together with the Acceptable Use Policy in Part II (collectively, the "Terms"), form a binding agreement between you ("Customer," "you," or "your") and AI Support Chat ("we," "us," "our," or the "Company"), the operator of aisupportchat.pro (the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

If you do not agree to these Terms, do not access or use the Service.

2. Description of Service

AI Support Chat provides a software-as-a-service live chat, support ticketing, and helpdesk platform that allows businesses to communicate with their own customers and end users, manage support requests, and (where enabled) use automated or AI-assisted chat features. We may add, modify, or discontinue features of the Service at any time, and we will make reasonable efforts to notify Customers of material changes.

3. Eligibility & Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for:

  • Providing accurate registration and billing information and keeping it current;
  • Maintaining the confidentiality of your account credentials, API keys, and access tokens;
  • All activity that occurs under your account, including activity by your agents, staff, or operators you grant access to;
  • Promptly notifying us of any unauthorized use of your account or any security breach.

4. Subscriptions, Billing & Trials

Paid plans are billed in advance on a recurring basis (monthly or annually, as selected) via our third-party payment processor. Except where required by law or expressly stated otherwise, fees are non-refundable. We may change pricing on renewal terms with advance notice as described on our pricing page or in your order form.

Free trials, if offered, convert to a paid subscription automatically unless cancelled before the trial ends, unless stated otherwise at signup. Failure to pay may result in suspension or downgrade of the Service after notice.

5. Customer Data & End-User Chats

"Customer Data" means the chat transcripts, tickets, contact information, and other content that you or your end users submit through the Service. As between you and us, you retain all rights to Customer Data. You grant us a limited license to host, process, transmit, and display Customer Data solely to provide, secure, support, and improve the Service.

You are responsible for having the necessary rights and consents to collect and share Customer Data with us, including data from your own end users who chat with your support team through our widget or dashboard, and for your own compliance with applicable privacy laws with respect to that data.

6. Intellectual Property

We and our licensors retain all right, title, and interest in the Service, including its software, design, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes and to support your own customers. You may not copy, reverse engineer, resell, sublicense, or create derivative works of the Service except as expressly permitted.

You retain ownership of any trademarks, logos, or branding you upload to customize your chat widget or helpdesk portal.

7. Third-Party Integrations

The Service may integrate with third-party tools (e.g., CRMs, email providers, AI/LLM providers, payment processors, analytics). Your use of any third-party integration is subject to that provider's own terms and privacy policy. We are not responsible for the acts, omissions, or availability of third-party services.

8. Availability & Support

We aim to keep the Service highly available but do not guarantee uninterrupted or error-free operation. Scheduled maintenance and factors outside our control (e.g., internet outages, third-party provider failures, force majeure events) may affect availability. If you are on a plan with a separately-agreed Service Level Agreement, that SLA governs uptime commitments and remedies; otherwise the Service is provided on an "as available" basis.

Part II — Acceptable Use Policy

9. Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs all use of the Service by you, your staff, and your end users. It is designed to keep the Service safe, lawful, and reliable for everyone. By using the Service, you agree not to, and will use commercially reasonable efforts to ensure your end users and agents do not:

9.1 Illegal or harmful activity

  • Use the Service for any unlawful purpose, or to violate any local, state, national, or international law or regulation;
  • Facilitate, promote, or provide support for fraud, scams, phishing, pyramid schemes, or deceptive commercial practices;
  • Sell, market, or support the sale of illegal goods or services, counterfeit goods, or items regulated or restricted by law (e.g., certain weapons, drugs, or controlled substances) without proper authorization.

9.2 Abuse, harassment & harmful content

  • Use chat, ticketing, or messaging features to harass, threaten, defame, stalk, or abuse any person;
  • Upload, transmit, or solicit content that is unlawfully violent, sexually exploitative of minors, or that promotes self-harm, terrorism, or hate based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

9.3 Security & system integrity

  • Probe, scan, or test the vulnerability of the Service or any related system or network, or breach or circumvent any security or authentication measures, without our prior written consent;
  • Introduce viruses, malware, worms, or other harmful code;
  • Access or attempt to access accounts, data, or systems you are not authorized to access;
  • Interfere with or disrupt the integrity or performance of the Service, including through excessive automated queries, denial-of-service attacks, or scraping outside of provided APIs.

9.4 Spam & unsolicited messaging

  • Use the Service's chat, email, or ticketing features to send unsolicited bulk messages, spam, or marketing communications in violation of applicable anti-spam laws (e.g., CAN-SPAM, CASL, GDPR e-privacy rules);
  • Harvest or collect end-user contact information without appropriate notice and consent.

9.5 Platform misuse

  • Resell, sublicense, or provide the Service to third parties as a standalone product without our written permission (white-labeling under an approved plan is permitted where offered);
  • Exceed reasonable usage limits in a way designed to circumvent plan pricing (e.g., splitting one organization's usage across many free accounts);
  • Use automated means to extract data from the Service other than through our documented API;
  • Use any AI/automated chat features to generate content that violates this AUP, or to misrepresent AI-generated responses as being from a human agent where such disclosure is legally required.

9.6 Intellectual property & confidentiality

  • Infringe or misappropriate any patent, trademark, copyright, trade secret, or other proprietary right of any party through your use of the Service;
  • Access, use, or disclose another customer's data without authorization.

10. Enforcement of the AUP

We may investigate suspected violations of this AUP and take any action we deem appropriate, including removing content, disabling features, suspending or terminating accounts, and reporting conduct to law enforcement, without liability to you. We may, but are not obligated to, monitor use of the Service for AUP compliance. If you become aware of an AUP violation, please report it using the contact details in Section 19.

Part III — Legal Terms

11. Suspension & Termination

You may cancel your subscription at any time through your account settings or by contacting support; cancellation takes effect at the end of the current billing period unless otherwise stated. We may suspend or terminate your access immediately for a material breach of these Terms (including the AUP), non-payment, or if required by law, and will provide notice where practicable. Upon termination, your right to use the Service ends, and we may delete Customer Data after a reasonable retention period, subject to any separate data export obligations we've agreed to.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your Customer Data, your violation of these Terms (including the AUP), or your violation of any third party's rights.

15. Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or an in-product notice, before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing Law & Disputes

These Terms are governed by the laws of [Insert Governing State/Country], without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved in the state or federal courts located in [Insert Venue], and you consent to personal jurisdiction there, unless applicable law requires otherwise.   • No Waiver: Our failure to enforce any right or provision is not a waiver of that right.
  • Assignment: You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force Majeure: Neither party is liable for delays or failures due to causes beyond reasonable control.
